These Terms & Conditions (“Terms”) govern your access to and use of the Purfek Storm Group website (the “Site”) and any related services, including inquiries, applications, bookings, studio access, and content production services (collectively, the “Services”). By using the Site or Services, you agree to these Terms.
If you do not agree, do not use the Site or Services.
1) Who We Are
The Site and Services are operated by Purfek Storm Group (“Purfek Storm,” “we,” “us,” or “our”). The studio location and production space in Jersey City, New Jersey (the “Studio”) is a private facility and is not open to the general public.
2) Eligibility & Industry-Only Access
Access to the Studio is exclusive and industry-restricted. Submitting an inquiry, application, or request does not guarantee approval, booking, or entry.
We may approve or deny access for any reason, including capacity, fit, security, conduct history, or operational needs. We may revoke approval at any time in our sole discretion.
3) Applications, Requests, and Account Information
You agree that all information you submit through the Site is accurate and current. You may not impersonate another person or misrepresent your identity, affiliations, or intent.
We may require additional verification before confirming any booking or granting access.
4) Bookings, Deposits, Fees, and Payments
If the Site allows booking requests or payment collection, the following apply:
- Scheduling: Bookings are not confirmed until you receive written confirmation from us.
- Rates/Fees: Rates and fees may change at any time. Your confirmed booking will be honored at the quoted rate.
- Deposits: We may require deposits or prepayment to confirm a reservation.
- Late Arrival/Overtime: Late arrivals may reduce your booked time. Overtime may be charged at an additional rate.
- Additional Charges: You are responsible for costs related to extra crew, equipment, damages, excessive cleanup, security incidents, or policy violations.
5) Cancellation & Rescheduling
Cancellation and rescheduling policies may vary by booking type and will be provided at the time of booking. Unless otherwise stated in writing:
- Requests to reschedule must be made with reasonable notice.
- No-shows and last-minute cancellations may result in forfeiture of deposits and/or additional fees.
- We may cancel or reschedule due to safety concerns, building issues, force majeure, or operational needs. If we cancel, we will work with you in good faith to reschedule or issue a refund of amounts paid for the cancelled time (excluding nonrefundable third-party costs).
6) Studio Rules, Safety, and Conduct
To protect the Studio, our team, and our clients, you agree to comply with all posted rules and staff instructions, including:
- No unlawful activity, harassment, threats, or unsafe conduct.
- Respect for equipment, sets, and building property.
- No unauthorized access to restricted areas.
- No smoking/vaping unless explicitly permitted.
- No weapons.
- No minors unless pre-approved and supervised.
- You are responsible for the conduct of all guests, talent, contractors, and crew you bring into the Studio.
We may remove anyone from the premises immediately for violations, without refund, and may ban future access.
7) Equipment Use & Responsibility
If equipment is provided, you agree to use it properly and only as authorized. You are responsible for:
- Any loss, theft, damage, or misuse caused by you or your party.
- Replacement/repair costs and any associated downtime or administrative fees.
- Ensuring your team has the skill to operate equipment safely (or booking our crew where required).
We may require proof of insurance for certain shoots or equipment packages.
8) Content, Recording, and Releases
You are responsible for obtaining all necessary permissions, licenses, clearances, and releases for your production, including from talent, guests, crew, music rights holders, and any third parties.
You represent and warrant that your content will not violate any law or infringe intellectual property or privacy rights.
9) Intellectual Property (Site + Brand)
The Site, including text, graphics, logos, photos, videos, and design elements, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, modify, distribute, or exploit Site materials without our written permission.
“Purfek Storm Group” and related marks are trademarks of Purfek Storm. Unauthorized use is prohibited.
10) Studio Photography & Our Promotional Use
We may take photos or video of the Studio space (not your confidential materials) for documentation, security, or marketing.
If we wish to use identifiable footage of you/your talent for promotion, we will seek permission when reasonably practicable. If you require a strict “no-media” environment, you must notify us in writing before the booking.
11) User Submissions & Feedback
If you submit ideas, suggestions, or feedback, you grant us the right to use them without restriction or compensation, unless otherwise agreed in writing.
12) Third-Party Links and Services
The Site may include links to third-party websites or tools. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
13) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee uninterrupted operation, error-free functionality, or that the Site will be free of viruses or other harmful components.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURFEK STORM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC BOOKING OR SERVICE GIVING RISE TO THE CLAIM, OR $100 IF NO PAYMENT WAS MADE.
15) Indemnification
You agree to defend, indemnify, and hold harmless Purfek Storm and its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from:
- Your use of the Site or Services,
- Your production, content, or conduct,
- Your breach of these Terms, or
- Any violation of law or third-party rights by you or your party.
16) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including power outages, building issues, severe weather, government actions, labor disputes, public health events, or internet/utility failures.
17) Privacy
Your use of the Site is also subject to our Privacy Policy.
18) Changes to These Terms
We may update these Terms at any time. Changes become effective when posted on the Site. Your continued use after changes means you accept the updated Terms.
19) Governing Law & Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
Any dispute will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
20) Termination
We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including suspected misuse or policy violations.
